Welcome to YoCharm! The terms "we", "us" and "our" refer to YoCharm. We operate this store at yocharm-shop.myshopify.com to provide you with a curated jewelry shopping experience (the "Services"). YoCharm is powered by Shopify.

By visiting or purchasing from our store, you agree to these Terms of Service and our Privacy Policy [LINK]. If you do not agree, please do not use our Services.

Section 1 — Who Can Use Our Store

By using our Services, you confirm that you are at least the age of majority in your province or state, or that you have parental or guardian consent to make a purchase. If you are purchasing on behalf of a minor (for example, as a gift), you take responsibility for that purchase.

You agree to provide accurate, current, and complete information when placing an order, and to keep your account credentials secure.

Section 2 — Our Products

YoCharm sells handcrafted glass bead jewelry, mystery scoop sets, and personalised aura reading products. Please note:

  • Colors and appearance may vary slightly from what you see on screen due to device display settings. UV color-changing effects are best seen under direct sunlight or UV light.
  • Mystery Scoop contents are curated surprises — specific items within a scoop cannot be requested or guaranteed.
  • Pick Your Aura products are personalised based on your zodiac sign, personality, and a tarot reading. The bracelet(s) selected are at our discretion based on your reading — exact styles cannot be specified.
  • We reserve the right to update product descriptions, discontinue products, or limit quantities at any time.

Section 3 — Orders & Presale

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order.

Presale orders: All Presale Drop 1 orders are subject to a 5–6 week fulfilment window from the date the drop closes. By placing a presale order, you acknowledge and accept this timeline.

Cancellations: Presale orders may be cancelled within 48 hours of purchase. After 48 hours, orders cannot be cancelled as curation and production begin shortly after the drop closes. Non-presale orders follow our standard Refund Policy [LINK].

Personalised orders (Pick Your Aura Bracelet, Pick Your Aura Bundle) are final sale once the reading process has begun. See our Refund Policy for details.

Section 4 — Pricing & Payment

All prices are listed in USD. Prices are subject to change without notice, but the price charged will always be the price shown at the time you place your order.

Prices do not include applicable taxes or shipping fees unless otherwise stated. Free shipping applies to orders of $25 USD or more (Canada and USA only).

You represent that your payment information is accurate and that you are authorised to use the payment method provided.

Section 5 — Shipping & Delivery

We ship to Canada and the United States only at this time.

Delivery timelines are estimates and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or circumstances outside our control. Once your order is transferred to the carrier, risk of loss passes to you.

Section 6 — Video Add-On & Social Media Consent

If you purchase the Packing Video or Reading Video add-on, you consent to your order being featured in a video posted to YoCharm's TikTok, Instagram, and/or YouTube channel. Your first name or a nickname of your choosing will be used. By purchasing this add-on, you grant YoCharm a non-exclusive, royalty-free licence to use this content for promotional purposes. If you would prefer a nickname, please include it in your order notes at checkout.

Section 7 — Intellectual Property

All content on this store — including the YoCharm name, logo, product names, photography, video, and written content — is owned by YoCharm or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any of our content without prior written permission.

Shopify's name, logo, and trademarks are the property of Shopify Inc.

Section 8 — Third-Party Links & Tools

Our store may contain links to third-party websites or use third-party tools (such as review apps or shipping trackers). We are not responsible for the content, accuracy, or practices of any third-party sites. Use of third-party tools is at your own risk.

Section 9 — Relationship with Shopify

YoCharm is powered by Shopify. However, all sales and purchases are made directly with YoCharm. Shopify is not responsible for any aspect of transactions between you and YoCharm, including any injury, damage, or loss resulting from purchased products. You hereby release Shopify and its affiliates from all claims arising from your purchases with YoCharm.

Section 10 — Privacy

Your personal information is handled in accordance with our Privacy Policy [LINK] and Shopify's Privacy Policy at shopify.com/legal/privacy. By using our Services, you consent to the collection and use of your information as described in those policies.

Section 11 — Reviews & Feedback

If you submit a review, photo, or other feedback, you grant YoCharm a perpetual, royalty-free licence to use it for promotional and operational purposes. You confirm that your feedback is honest, your own, and does not infringe any third-party rights.

Section 12 — Errors & Inaccuracies

We do our best to ensure all pricing and product information is accurate. If an error occurs, we reserve the right to correct it and, where necessary, cancel affected orders with notice to you.

Section 13 — Prohibited Uses

You may only use our store for lawful, personal purchases. You may not use our Services to resell products commercially, scrape data, transmit spam or malware, impersonate others, or engage in any activity that harms YoCharm, Shopify, or other users.

We reserve the right to suspend or terminate access for any violation of these Terms.

Section 14 — Disclaimer of Warranties

Our products and Services are provided "as is." We make no guarantees that products will meet your expectations beyond what is described in the listing. UV color-changing effects depend on sunlight and UV exposure conditions and may vary.

Some jurisdictions do not allow the exclusion of implied warranties — in those cases, our liability is limited to the maximum extent permitted by law.

Section 15 — Limitation of Liability

To the fullest extent permitted by law, YoCharm and its affiliates will not be liable for any indirect, incidental, or consequential damages arising from your use of our Services or products. Our total liability to you will not exceed the amount you paid for the order in question.

Section 16 — Indemnification

You agree to indemnify and hold harmless YoCharm, Shopify, and their respective affiliates from any claims, losses, or damages (including legal fees) arising from your breach of these Terms or your violation of any law or third-party rights.

Section 17 — Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes will be subject to the jurisdiction of the courts of Ontario.

Section 18 — Changes to These Terms

We may update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of our store after changes are posted constitutes acceptance of the updated Terms.
